A Restraining Order Can Affect Your Right to Carry FirearmsIf you are a party to a civil restraining order — whether you filed or had one filed against you — you violate federal law if you carry a firearm while the order is in effect. If you are convicted of domestic violence in criminal court, you will be permanently banned from owning or carrying a firearm. You will not be allowed to hunt, take target practice or even carry a gun for your own safety. Take allegations of domestic violence seriously. Contact my Greenville law office for a consultation. |

How Domestic Violence Restraining Orders Work
A domestic violence restraining order can be obtained against a spouse, boyfriend or girlfriend, anyone in your household — and sometimes, people who do not live with you.
In domestic violence cases, the person complaining goes to court seeking the restraining order. A domestic violence restraining order allows the police to arrest the defendant without a warrant if they have probable cause to believe the order has been violated.
The restraining order forbids you from calling, e-mailing, writing or visiting the complainant for any reason — even through third parties. If the police arrest you for violating a domestic violence restraining order, you will have to appear before a judge before you can get bail, which could take two days.
Take Domestic Violence Allegations Seriously
In my experience, allegations of domestic violence or abuse are not unusual when parties are involved in divorce or separation proceedings or other domestic law disputes.
Regardless of whether such charges are true, I recommend that you immediately respond to and address claims of domestic violence.
I will act as your advocate, ensuring that you understand what is happening, know your options, and make the best decisions to protect your interests.
